1. Acceptance of Terms

By accessing or using Not So Vanilla ("Platform," "we," "us," or "our") at notsovanilla.app or any creator subdomain, you agree to be bound by these Terms of Service and all applicable laws. If you do not agree, you must not use the Platform.

2. Age Requirement

You must be at least 18 years of age to access or use this Platform. By entering, you represent and warrant that you are 18 or older and legally permitted to view adult content in your jurisdiction. We reserve the right to terminate access for any user we have reason to believe is under 18.

3. Creator Accounts

Creators who register on the Platform agree to the following:

  • You are solely responsible for all content you upload or distribute.
  • All content must feature only individuals who are 18 years of age or older and have provided explicit written consent to appear.
  • You must maintain age verification records for any person depicted in your content and provide them to us upon request.
  • You may not upload content that is illegal, depicts minors, or violates any third party's rights.
  • All transactions processed through the Platform are subject to the Platform's revenue share as disclosed at registration. Soliciting off-platform payments to circumvent Platform fees is a material breach of these Terms and may result in immediate account termination.

4. Purchases and Payments

All sales on the Platform are final unless otherwise stated. Digital content is delivered electronically and becomes accessible in your library upon payment confirmation. Physical items are subject to availability and shipping timelines disclosed at checkout. We process payments via CashApp and other approved methods disclosed at checkout. We do not store payment card data.

5. Prohibited Conduct

You agree not to:

  • Access the Platform if you are under 18 or in a jurisdiction where adult content is prohibited.
  • Reproduce, redistribute, or share any purchased content outside of your personal use.
  • Attempt to circumvent access controls, signed URLs, or content protection measures.
  • Reverse engineer, scrape, or harvest any portion of the Platform.
  • Upload malware, spam, or any content that disrupts the Platform's operation.
  • Impersonate any creator, user, or Platform staff.

6. Platform Liability (CDA § 230)

Not So Vanilla is an interactive computer service as defined under 47 U.S.C. § 230. The Platform is not the publisher or speaker of any content uploaded, posted, or transmitted by creators or users. The Platform shall not be treated as the publisher or speaker of such content and is not liable for content provided by third-party creators, including its accuracy, legality, or appropriateness. Creators, not the Platform, are solely responsible for their content.

7. DMCA / Copyright

The Platform respects intellectual property rights and complies with the Digital Millennium Copyright Act. To submit a takedown notice or counter-notice, visit /legal/dmca.

8. Intellectual Property

All content uploaded by creators remains the intellectual property of the respective creator. By uploading content, creators grant the Platform a limited, non-exclusive license to host, display, and distribute that content to purchasers as needed to operate the Platform. The Platform's branding, design, and code are proprietary and may not be copied or reused.

9. Disclaimers and Limitation of Liability

The Platform is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Platform, including but not limited to loss of content, revenue, or data. Our total liability to you for any claim shall not exceed the amount you paid to us in the 30 days preceding the claim.

10. Termination

We may suspend or terminate your account at any time for any violation of these Terms. Creators whose accounts are terminated forfeit any unpaid earnings if the termination is due to a material breach (including illegal content or fee circumvention).

11. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of competent jurisdiction. You waive any right to a jury trial.

12. Changes to These Terms

We may update these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms. We will note the "Last updated" date at the top of this page when changes are made.
