Designated DMCA Agent

Not So Vanilla has designated the following agent to receive notifications of claimed infringement under the Digital Millennium Copyright Act:

This agent is registered with the U.S. Copyright Office DMCA Directory at copyright.gov/dmca-directory.

Submitting a Takedown Notice

To submit a valid takedown notice under 17 U.S.C. § 512(c)(3), your written notification must include ALL of the following:

1. A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right being infringed.
2. Identification of the copyrighted work claimed to have been infringed. If multiple works are covered by a single notification, a representative list of such works.
3. Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material (e.g., the URL where the material appears on our site).
4. Information reasonably sufficient to permit us to contact you: name, address, telephone number, and email address.
5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.

Counter-Notice

If content you submitted was removed in response to a DMCA takedown notice and you believe the removal was in error or the result of misidentification, you may submit a counter-notice under 17 U.S.C. § 512(g)(3). Your counter-notice must include:

1. Your physical or electronic signature.
2. Identification of the material that was removed or disabled, and the location where the material appeared before it was removed.
3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
4. Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if outside the U.S., any judicial district in which the service provider may be found.

Repeat Infringers

Not So Vanilla will terminate the accounts of users who are determined to be repeat infringers in appropriate circumstances, consistent with 17 U.S.C. § 512(i).
